These Terms of Service govern the use of Pexev by companies and individuals (hereinafter 'Customer'). By completing a subscription the Customer accepts these terms.
These Terms apply to all subscriptions and services of {{businessName}} ('Pexev'). Deviating customer terms shall not apply unless agreed in writing.
The contract is formed upon successful completion of the Stripe Checkout process. The confirmation email from Pexev constitutes the order confirmation.
Pexev provides a cloud-based platform for managing guestlists, QR check-in, promoter links and event analytics for clubs and event organisers. The exact feature set per plan is described on the pricing page.
Prices are in CHF, excluding any applicable VAT. Billing is monthly via Stripe. A 30-day free trial applies to new accounts (no credit card during the beta phase). Plan upgrades take effect immediately, downgrades at the start of the next billing period.
The Customer shall ensure that all contact and billing information is accurate and up to date. The platform may not be used for unlawful purposes. The Customer bears data protection responsibility towards their guests and shall ensure that the collection of guest data complies with Swiss data protection law.
Pexev processes guest data exclusively on behalf of the club (data processor under Art. 28 GDPR and Art. 9 nDSG). These Terms, together with the Privacy Policy, constitute the Data Processing Agreement (DPA).
Pexev aims for 99% uptime. No Service Level Agreement (SLA) is guaranteed during the MVP phase. Maintenance windows will be announced in advance where possible.
Pexev's liability is limited to the subscription fee paid in the affected month. Pexev is not liable for indirect damages, lost profits or data loss, to the extent permitted by law.
Subscriptions run on a monthly basis and renew automatically. Cancellation is possible at any time via the Stripe Customer Portal and takes effect at the end of the current billing period.
Swiss law applies. The place of jurisdiction is {{jurisdiction}}. Statutory consumer protection rules take precedence where applicable.
